I HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge CROOKED OAKS RV PARK LLC from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known of unknown, in law or equity, that I ever had or may have, arising from or in any way related to my camping activities on the premises of land owned by ECH Crooked Oaks, LLC in the County of HORRY, in the state of SC provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.

I understand that the activities in which I will participate are inherently dangerous and may cause serious of grievous injuries, including bodily, damage to personal property and/or death; that injuries can occur because of the condition of the land, and that the land may pose such dangerous conditions due to snakes, insects, spiders, ditches, erosions, sharp rocks, culverts, fallen trees, branches, snow, mud, or other natural and man-made hazards. On behalf of myself, my heirs, assigns and next of kin, I waive all claims for damages, injuries and death sustained to me or my property that I may have against the aforementioned release party to such activity.

By this Waiver, I assume any risk, and take full responsibility and waiver and claims of personal injury, death or damage to personal property and real property owned by ECH Crooked Oaks, LLC including but not limited to camping and building a campsite on the land, using the land in any manner, form or fashion, including swimming, hiking, crafts sports, field trips, fishing, campfires, and engaging in any outdoor activities or other related activities on and off the premises.

This WAIRER AND RELEASE contains the entire agreement between the parties, and supersedes and prior written or oral agreements between them and concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only the prior written consent of all parties.

I have read, understand and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by signing this WAIVER AND RELEASE I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My signature is proof of my intention to intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 years of age or older and mentally competent to enter into this waiver. This agreement and its terms and provisions will include any minors who accompany me or are under my care. I further agree that I shall assume responsibility for watching and caring for minor’s safety and guarding against all hazards, natural or man made, whether expressly mentioned in this WAIVER AND RELEASE or otherwise.

Crooked Oaks RV Park LLC Policies & Rules

General:  Check in 1:00PM Check Out 11:00AM

1. Tenants and Guests are responsible for any damage or injury caused by themselves, their children and/or pets.
2. Tenant assumes any and all risks associated with the foregoing and agrees to hold Landlord harmless from and indemnify Landlord against the same.
3. The resort is not responsible for personal injuries or damage, loss or theft of any personal property or vehicle.
4. We reserve the right to evict any person(s) who does not comply with the rules and policies.
5. All guests and visitors must register in the office upon arrival or Guard Shack after hours.
6. Crooked Oaks RV Park LLC does not allow the delivery of mail or packages to any guests.  Guests must make arrangements to have their mail or packages delivered to a third-party location for pickup.
7. All guests and visitors must display parking passes while on property.
8. All Motorhomes, RVs or Travel Trailers must be in good working order and appearance.
9. We reserve the right to refuse access to any guests whose vehicle is deemed to be unacceptable.
10. Tent camping is permitted on tent sites only.
11. Tents are limited to a maximum of two per site and cost an additional $10 per tent, per night.
12. Total number of guests in any space cannot exceed the maximum capacity for that site.
13. Maximum of 12 people total at a site at any given time.
14. Visitors are welcome at guest sites between the hours of 9 am & 10 pm, but they must first register at the office.
15. Visitors are not permitted to stay overnight.  All visitors are required to leave by 10:00 PM.
16. All visitors must pay $8-dollar visitors fee per vist.
17. No overnight parking or storage of trailers.
18.  Tiki torches are PROHIBITED.
19. Propane grills and propane fire pits are allowed.
20. Blowup mattresses, sleeping bags and cots are not allowed outside.
21. Maintenance on RV’s or vehicles on property is not allowed unless it is a camp ending event or approved by managment.
22. Washing RVs or vehicles on property is not allowed unless approved or requested by management.
23. The use of any paint products or chemicals is prohibited.
24. Clotheslines are not allowed.
25. Guests may not hang any items from the trees.
26. All sites are to be kept neat and clean for the duration of your stay.
27. Only 1 RV and a maximum of 2 other vehicles allowed per site unless stated otherwise.
28. All trash is to be disposed of in enclosed trash receptacles throughout the resort.
29. DO NOT leave trash out overnight. Trash will be picked up curbside by 12:00PM Daily
30. Boats, boat trailers, cargo trailers or car dollies must fit on the concrete pad of the site you rented. No parking on the grass or other sites
31. Drones or other remote controlled machines may not be used at any time on the property.
32. Crooked Oaks RV Park LLC is in a natural wildlife habitat area.  There are coyotes, birds of prey and reptiles.  All guests should ensure pets and small children are supervised at all times.
33. Any area that is landscaped, rocked or deemed natural areas are off limits.
34. We are a pet friendly park however, pets must be cleaned up after immediately!
